8.1

Opportunity to be Heard

8.1.1

6922 Saanich Cross Road (Small Lot Development)

Purpose: Council will be considering an application for a Subdivision and Development Permit with variances for a three-lot subdivision in the existing RN Zone.  

Statement:  This is an Opportunity to be Heard for variances to the Development Permit. If you are a property owner affected by the proposal, you are afforded the opportunity to speak regarding the to variances to allow frontage, rear setback, front setback, and parking variances for the two proposed lots and existing lot. Approval of the variances are subject to a rezoning application, to be considered as item #12.2.1 of tonight's agenda. This rezoning is consistent with the OCP and therefore the District is prohibited from holding a public hearing. Approval of the Development Permit with variances will be considered at a future Council meeting.

1048 Clarke Road – Development Permit (SSMUH)

Report from the Director of Planning and Building Services.

• Recommendation:

  That Development Permit No. 3060-20-16/24 for three townhomes at 1048 Clarke Road be authorized for issuance.

11.2

BC Housing Progress Report on District’s Provincial Housing Targets – Reporting Period 1.1 (July 2024 – December 2024)

• Recommendation:
  1. That the BC Housing Target Progress Report Form for Reporting Period 1.1 (July 1, 2024 to December 31, 2024) as presented in Appendix A be approved.

  2. That staff be directed to submit the BC Housing Target Progress Report Form – Reporting Period 1.1 (July 1, 2024 to December 31, 2024) to the Ministry of Housing.

  3. That the District request the Province for additional funding resources for Housing related initiatives.

11.3

Central Saanich Speed Reduction Project

• Recommendation:

  Direct staff to draft a bylaw to update the District of Central Saanich’s road speed limits based upon the Proposed Network Speed figure for presentation in Q2 2025.

  That staff be directed to enter into a bilateral agreement with the Capital Regional District (CRD) to allow the signing of the Local Governing Authority Agreement with TELUS for Next Generation 9-1-1 implementation.

12.2.1

6922 Saanich Cross Road (Small Lot Development)

• Recommendation:

  That draft Zoning Bylaw Amendment Bylaw No. 2216, 2024 (6922 Saanich Cross Road) be introduced and given first and second reading. 

• Recommendation:

  That draft Zoning Bylaw Amendment Bylaw No. 2216, 2024 (6922 Saanich Cross Road) be given third reading. 

• Recommendation:

  That a covenant be registered restricting the maximum number of units to two per new lot that is less than the minimum subdivision area (750m2) prior to consideration of adoption. 

• Recommendation:

  That a covenant be registered to dedicate the current 142.9m2 statutory right of way area to the District as road dedication. 

• Recommendation:

  That amenity contributions toward the Affordable/Housing Community Amenity Reserve Fund and toward the General Amenity Reserve Fund, totaling $15,000, be provided prior to bylaw adoption. 

12.2.2

1934 Hovey Rd – Revised Proposal (January)

• Recommendation:
  1. That OCP Amendment Bylaw No. 2205, 2024 (1934 Hovey Road) be referred to a public hearing.
  2. That Second Reading for Zoning Amendment Bylaw No. 2206, 2024 (1934 Hovey Road) be rescinded.
  3. That Zoning Amendment Bylaw No. 2206, 2024 (1934 Hovey Road) be given Second Reading as amended and referred to a public hearing.
  4. That with regard to Development Permit Application 3060-20-10/23 (1934 Hovey Road), staff schedule an Opportunity to be Heard on the following variances:
     • Increase the maximum permitted height for the west building from 15.0 metres to 15.4 metres;
     • Increase the maximum permitted projection for balconies on the west building that face Hovey Road from 0.6 metres to 1.4 metres;
     • Increase the maximum permitted lot coverage for the west building from 45% to 46%;
     • Increase the maximum permitted lot coverage for the east building from 45% to 55%;
     • Decrease the minimum required rear yard setback for the east building from 10.5 metres to 5.0 metres;
     • Decrease the minimum required side yard setback for the east building from 6.0 metres to 3.0 metres for the west side yard setback;
     • To permit up to 14 residential parking spaces to be provided on an adjacent lot;
     • To reduce the overall parking requirement for both lots from 281 spaces to 192 spaces;
     • To reduce the required long term bike parking stalls for the east building from 86 to 56 long term stalls and 15 mobility scooter spaces;

14.1

Notice of Motion Submitted by Councillor Riddell - January 15, 2025

Notice of motion regarding the temporary use of Hovey Road property for community benefit. 

For introduction. 

WHEREAS the Hovey Road property was purchased for the future construction of new civic facilities;
WHEREAS the property is currently vacant and presents an opportunity for interim use that can provide community benefit;
WHEREAS the recent Parks and Trails Plan engagement identified community priorities and ideas that may inform potential uses of the property;
THEREFORE BE IT RESOLVED that staff be directed to report back with options for the temporary use of the Hovey Road property to benefit the community, with consideration given to ideas and priorities identified in the Parks and Trails Plan engagement process.

14.2

Notice of Motion Submitted by Councillors Newton and Paltiel

Notice of motion regarding a request for an update on the plans in place to mitigate crop damage by Canada Geese.

For introduction. 

WHEREAS the CRD acknowledges there is a lack of a coordinated approach to managing goose populations across the region has resulted in moving geese and their associated impacts into new areas, continued expansion of nesting and over-wintering populations, and increasing ecological, economic, and social impacts to agricultural and recreational lands, estuaries and wetlands.1 1. https://www.crd.bc.ca/education/concerns/regional-goose-management  
 
WHEREAS the Goose Population around the region continues to increase, with a CRD report declaring the Canada goose population in the capital region doubles in size every four years.2 2. https://www.crd.bc.ca/about/news/article/2023/02/08/regional-canada-goose-management-service-bylaw-adopted  
 
WHEREAS annual crop loss for local farms continues to be significant with some farmers estimating upwards of 10% crop loss in the 2024 farming season in Central Saanich and other areas areas within the CRD being farmed.
 
THEREFORE BE IT RESOLVED that the District of Central Saanich request an update on the CRD’s Regional Canada Goose Management Working Group and what plans are in place for the 2025 and 2026 growing seasons to mitigate crop damage by Canada Geese. 
 
THEREFORE BE IT ALSO RESOLVED that the District of Central Saanich forward any information of an update to PAAC for their information, if that information hasn’t already been forward to the Commission.

Staff Note: The District has been investigating the scope of operations since September 2022, including consulting with other enforcement agencies. The investigation remains open and concerns reported continue to be documented and reviewed as part of the file. As an active file,  the District cannot disclose specifics at this time. Additional information about this matter can also be sought out by contacting the Ministry of Environment and Agricultural Land Commission directly for status on their respective legislation. The Farm Industry Review Board is also another available agency to provide support and clarification about noise and dust (which may be protected under the Right to Farm Act) resulting from this operation.

CLOSED MEETING

16.1

Motion to Close

• Recommendation:

  That Council convene a closed meeting pursuant to the following subsections of the Community Charter:

  90(1) A part of a council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:

  • (e) the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality; and
  • (k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the council, could reasonably be expected to harm the interests of the municipality if they were held in public.

  90(2) A part of a council meeting must be closed to the public if the subject matter being considered relates to one or more of the following

  • (b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

  Following adoption of the above motion, the meeting will be closed to the public.
