  • Recommendation:

    That the agenda of the April 22, 2024 Regular Council meeting be approved as circulated.

  • Recommendation:

    That the minutes from the April 8, 2024 Regular Council meeting be adopted as circulated.

  • Recommendation:

    The Saanich Peninsula Accessibility Advisory Committee recommends to the Council's of the District of North Saanich, the District of Central Saanich, and the Town of Sidney that: 

    The District support National AccessAbility Week (May 26-June 1) by using their communication channels to
    promote awareness of AccessAbility Week and AccessAbility Day at the SHOAL Centre on Saturday, June 1.

Report from the April 4, 2024 PESC Meeting. 

  • Recommendation:

    That the Parks and Environment Standing Committee recommends to Council:

    That a proposed addition to the Turgoose trail be referred to staff for consideration for incorporation within the Parks and Trails Master Plan. 

  • Recommendation:

    That the Parks and Environment Standing Committee recommend to Council:

    That connective access to Cooperidge Park be considered for incorporation within the Parks and Trails Master Plan. 

  • Recommendation:

    That the Parks and Environment Standing Committee has received this report for information and recommend to Council:

    That Council provide any additional input to be considered when preparing a draft Parks and Trails Master Plan during the next phase of the project.

    That Five Year Financial Plan Bylaw No. 2183, 2024 be adopted.

    That Tax Rates Bylaw No. 2184, 2024 be adopted.

Minor amendment to change the reference to the new Zoning Bylaw. 

  • Recommendation:

    That third reading of Central Saanich Land Use Bylaw Amendment Bylaw No. 2079, 2023 be rescinded.

  • Recommendation:

    That Central Saanich Land Use Bylaw Amendment Bylaw No. 2079, 2023 be amended to change the references from the Central Saanich Land Use Bylaw No. 2072, 2021 to Central Saanich Zoning Bylaw No. 2180, 2024, and citation of the bylaw be amended to Central Saanich Zoning Bylaw Amendment Bylaw No. 2079, 2024.

  • Recommendation:

    That Central Saanich Zoning Bylaw Amendment Bylaw No. 2079, 2024 be given third reading, as amended.

    That Central Saanich Land Use Bylaw Amendment Bylaw No. 2120, 2023 be amended to change the references from the Central Saanich Land Use Bylaw No. 2072, 2021 to Central Saanich Zoning Bylaw No. 2180, 2024, and citation of the bylaw be amended to Central Saanich Zoning Bylaw Amendment Bylaw No. 2120, 2024.

  • Recommendation:

    That Central Saanich Zoning Bylaw Amendment Bylaw No. 2120, 2024 be given third reading, as amended.

Public Hearing held April 22, 2024. Consideration of adoption of bylaw pending registration of covenant.

  • Recommendation:

    That Land Use Bylaw Amendment Bylaw No. 2156 (1445 Benvenuto Avenue) be given Third Reading. 

  • Recommendation:

    That prior to bylaw adoption a covenant be registered to secure that the restaurant use is permitted subject to the following conditions (formerly outlined in the TUP):

    1. That approval under Agricultural Land Commission (ALC) resolution #143/2013 remains valid, including:
      1. Church & State Winery must maintain, at a minimum, the current level of grape production directly associated with the winery;
      2. The liquor products sold on the premises must be, to the greatest extent possible, those that derive the majority of agricultural inputs from agricultural producers in British Columbia to manufacture such liquor products, and the liquor products are brewed, distilled or fermented in British Columbia;
    2. The Owner shall manage its operations in a manner such that: 
      1. any music or other continuous noise (other than from normal farm practices), shall not exceed 60 decibels measured at the edges of the property;
      2. during special events Church and State staff will monitor sound levels at the property boundaries hourly after 8:00pm and make adjustments accordingly to ensure the average continuous sound level does not exceed the 60 decibel limit;
      3. hours of operation for outdoor events is restricted to 8:00pm;
      4. hours of operation for indoor events is restricted to 11:00pm, with no outside activity on the deck area of the winery building after 10:00pm;
      5. the number of events is limited to a maximum of 75 annually, 12 monthly or three weekly;
      6. during special events where outdoor activities are involved the number of people on the Winery property must not exceed the total occupant load of the Winery building (400 people);
      7. outdoor special events are restricted as follows:
        1. no more than eight events annually larger than 100 people to a maximum of 400 people, all of which will be subject to 14 day prior written notification to the District of Central Saanich and adjoining property owners of the Winery;
        2. smaller outdoor events are not to exceed 100 people;
      8. maintenance of a good neighbour policy to monitor and address any neighbourhood impacts from activities at the Winery.

Rescinding bylaw due to changes to basements. 

  • Recommendation:

    That first, second, and third readings of Central Saanich Land Use Bylaw Amendment Bylaw No. 2118, 2023 be rescinded.

  • Recommendation:

    That the May 13, 2024 Regular Council meeting start time be changed to 6:30 p.m.

  • Recommendation:

    That Council convene a closed meeting pursuant to the following subsections of the Community Charter:

    90(1) A part of a council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:

    • (a) personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; and
    • (e) the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality.

    90(2) A part of a council meeting must be closed to the public if the subject matter being considered relates to one or more of the following:

    • (b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

    Following adoption of the above motion, the meeting will be closed to the public.
